In Short: We offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies.
As part of our Services, we offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies (collectively, "AI Products"). These tools are designed to enhance your experience and provide you with innovative solutions. The terms in this Privacy Notice govern your use of the AI Products within our Services.
Use of AI Technologies
We provide the AI Products through third-party service providers ("AI Service Providers"), including OpenAI. As outlined in this Privacy Notice, your input, output, and personal information will be shared with and processed by these AI Service Providers to enable your use of our AI Products for purposes outlined in "WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?" You must not use the AI Products in any way that violates the terms or policies of any AI Service Provider.
Event import (flyers and text). If you choose to create an event from a flyer photo or pasted text, the image or text you submit is sent to OpenAI, our AI service provider, to extract event details (such as title, date, time, venue, price, and description) and prefill a draft for your review. This happens only when you use the import feature and only after you have enabled AI features. You can disable AI features at any time in Settings; declining does not prevent you from creating events manually. Submitted content is processed under OpenAI's API terms solely to generate your draft.
Business listing assistant. If you choose to create or update a business listing, the photo (such as a storefront, menu board, or a screenshot of an Instagram profile) or pasted business text you submit is sent to OpenAI, our AI service provider, to draft business listing fields (such as name, category, description, and social links) and prefill a draft for your review. This happens only when you use this feature and only after you have opted in. You can disable AI features at any time in Settings; declining does not prevent you from creating or updating a business listing manually. Submitted content is processed under OpenAI's API terms solely to generate your draft and is not used to train OpenAI's models.
Instagram Business Connect. If a business owner connects their Instagram account to AyAi, we periodically read recent posts from that account through Instagram's official API (with the owner's authorization) and send the post caption or image to OpenAI, our AI service provider, to draft event listings for the owner's review. Drafts are never published automatically — the owner reviews, edits, and submits each draft, and every submission goes through the same review as a manually created event. Owners can disconnect their account at any time in the business dashboard. Disconnecting removes AyAi's stored Instagram access token and any imported event drafts that have not been published; you can also request deletion at https://www.ayai.app/legal/data-deletion.html or by removing AyAi from your Instagram settings. Content processed this way is handled under OpenAI's API terms solely to generate drafts and is not used to train OpenAI's models.
Automated moderation review. When you submit an event, the details you provide (such as title, description, date, time, venue, and category) are sent to OpenAI, our AI service provider, to automatically review the submission for spam, safety, and completeness and to help our team prioritize its moderation queue. This is an automated assessment only; a human makes the final decision to approve or reject every submission, and no submission is published or removed based solely on this automated review. Submitted content is processed under OpenAI's API terms for this purpose.
Night planner. When you use the night planner to build a plan for tonight, we send your request along with your selected interests and the public listing details of the events and businesses we suggest (including each listing's title, description, category, venue, and listed hours) to OpenAI, our AI service provider, to sequence a personalized plan. This happens only when you use this feature and only after you have opted in — the same consent as the chatbot. You can disable AI features at any time in Settings; declining still lets you build a plan from tonight's listings without AI. Submitted content is processed under OpenAI's API terms solely to generate your plan and is not used to train OpenAI's models.

6. HOW DO WE HANDLE YOUR SOCIAL LOGINS?
In Short: If you choose to register or log in to our Services using a social media account, we may have access to certain information about you.
Our Services offer you the ability to register and log in using your third-party social media account details (like your Facebook or X logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile information we receive may vary depending on the social media provider concerned, but will often include your name, email address, friends list, and profile picture, as well as other information you choose to make public on such a social media platform.
We will use the information we receive only for the purposes that are described in this Privacy Notice or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. We recommend that you review their privacy notice to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.
7. HOW LONG DO WE KEEP YOUR INFORMATION?
In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.
We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than the period of time in which users have an account with us.
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
8. HOW DO WE KEEP YOUR INFORMATION SAFE?
In Short: We aim to protect your personal information through a system of organizational and technical security measures.
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.
9. DO WE COLLECT INFORMATION FROM MINORS?
In Short: We do not knowingly collect data from or market to children under 18 years of age.
We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. In Short: You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.
Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below.
However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.Account Information

11. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.
California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.
Request Verification
Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.
If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request and the agent will need to provide a written and signed permission from you to submit such request on your behalf.Appeals

13. LOCATION DATA
AyAi uses location data, when permission is granted by the user, to provide nearby filtering, distance-based discovery, and location-based features such as check-ins.
We may process approximate or precise location data depending on the feature and user permission. Some location-related actions — such as verified check-ins, recent location preference, or last known city — may be stored to operate the service, prevent abuse, and show activity signals to other users where appropriate. Other location data, such as live position for nearby filtering, is processed in real-time without persistent storage.
You may revoke location access at any time through your device settings. Revoking location access may limit the functionality of nearby filtering, check-ins, and other location-based features.
14. AGGREGATED INSIGHTS, ANALYTICS, AND SPONSORED CONTENT
AyAi does not sell personal information that directly identifies you, such as your name, email address, direct messages, account login information, or precise personal location history.
AyAi may use aggregated, de-identified, or anonymized information to operate, improve, and monetize the service. This may include creating business analytics, local trend reports, category-level insights, sponsored placement measurement, and audience insights for businesses, venues, event organizers, or partners.
Examples of aggregated insights may include total event views, business profile views, search trends, saves, "Going" or "Maybe" counts, check-in totals, category interest, general geographic interest, or time-of-day demand trends. These insights are intended to describe groups, trends, or activity patterns and are not intended to identify individual users.
AyAi may also use information about how users interact with the service to show relevant sponsored, boosted, featured, or promoted content within AyAi. Businesses do not receive your personal contact information, direct messages, or individual precise location history through these sponsored placements.
If AyAi's data practices change in a way that requires additional notice, consent, or opt-out rights under applicable law, AyAi will update this Privacy Policy and provide any required choices.
15. ACCOUNT DELETION
If you create an AyAi account, you may request deletion of your account through the in-app account settings or by contacting support@ayai.app. Account deletion removes your account record and associated personal data that AyAi is not legally required to retain. Some information may be retained for a limited period where necessary for legal compliance, fraud prevention, safety, dispute resolution, enforcement of these terms, or backup integrity. Deleted accounts are generally processed within 30 days.
16. TRACKING AND ADVERTISING IDENTIFIERS
AyAi does not use third-party advertising identifiers or track users across other companies' apps or websites for advertising purposes unless required notice and consent are provided under applicable platform rules, including Apple's App Tracking Transparency framework where applicable.
